Terms of Service
1. Who we are
JacotePOS is a shop till (point of sale) service at jacote.blog, run by Jacote in Kenya ("we", "us").
Business registration: [registered business name and number to be added].
Support: WhatsApp +254 799 654 411 · Calls +254 713 074 137 · Email jacotewambura@gmail.com.
2. Who can use JacotePOS
- You must be at least 18 and allowed to act for the shop you register ("your shop").
- Each shop registers once with one email and password. That account signs in your shop's devices; your staff then use their own PINs.
- Keep the shop password and your PINs secret. You are responsible for everything done with them. Tell us at once if you think someone else has them.
- We approve new shops before they can sell. We may refuse or suspend a shop that breaks these terms, gives false details, or puts other shops or the service at risk.
3. Price and payment
- Every new shop gets a free 30-day trial with all features. Shops already using JacotePOS when plans began get 30 free days from that day.
- After the trial, the plans are: Kiosk KES 500 a month (1 device), Duka KES 1,000 a month (up to 3 devices), Gas KES 1,200 a month (up to 5 devices, with gas cylinder tools) and Biashara Plus KES 1,500 a month (any number of devices, with gas cylinder and milk farmer tools). Biashara Pro has a monthly price, number of devices, tools and extras agreed with each shop; the agreed terms are confirmed in writing (for example on WhatsApp) and shown in the shop's till. If a plan without gas tools is chosen later, gas records stay visible and held cylinder deposits can still be returned. Paying for 12 months costs the same as 10 months. An owner with several shops on one account pays for each shop separately, and pays 10% less for the third shop and each shop after it.
- You pay by M-Pesa as shown in the till under Settings, and send us the M-Pesa message. Your paid-until date moves forward once we record the payment.
- The free trial and every plan work the same way at the end: the till reminds you from 7 days before it ends. If it isn't paid, you have 3 days' grace; after that the till stops selling by itself but you can still see and export your records until you pay. We do not delete records for non-payment without telling you first.
- We will tell you at least 30 days before any price change. You can stop using the service at any time and take your records with you (section 7).
4. Your shop's responsibilities
- Accurate records. You are responsible for the prices, stock, sales, credit, farmer and staff details your shop enters.
- Tax. JacotePOS receipts are not KRA eTIMS invoices. You remain responsible for your tax obligations, including issuing eTIMS invoices where the law requires them.
- Payments. M-Pesa and card codes are typed in by your staff and are not checked with Safaricom or your bank. Check your M-Pesa and bank statements yourself.
- The people in your records. Your shop decides what it records about its customers, farmers and staff. You must have a lawful reason to keep that information, tell them what you keep, and follow the Data Protection Act, 2019.
- Licences and law. You follow the laws for your business, for example age limits on selling alcohol, and any licences you need.
- Devices and internet. You provide working phones or computers and an internet connection.
5. Fair use
Do not use JacotePOS to break the law, to try to reach another shop's records, to copy or resell the service, to overload or attack it, or to store anything unlawful. Doing so can lead to immediate suspension.
6. How the service works
- Offline sales. The till keeps working without internet and uploads sales when the connection returns. Sales saved only on a device can be lost if the device is lost, reset or its browser data is cleared before they upload. Keep the page open until the "No internet" message goes away.
- Availability. We work to keep JacotePOS running, but we cannot promise it will never be slow or unavailable, for example during internet, power, hosting or maintenance problems.
- Changes. We improve JacotePOS often. We may add, change or remove features. If we remove something important to you, we will tell you first where we can.
- Backups. We keep backup copies of shop records, but you should also save your Reports regularly (for example the daily spreadsheet).
7. Your records belong to you
- Your shop owns the records it enters. We only use them to run, support, secure and back up JacotePOS for you, and as described in our Privacy Policy.
- We do not sell your records, and we do not show one shop's records to another.
- You can ask us for a copy of your shop's records at any time.
8. Support
If anything breaks down, contact Jacote on WhatsApp (fastest; send a photo of the screen), by phone or by email, using the details in section 1. We aim to reply within one working day, and sooner for problems that stop your shop from selling.
9. Limits of our responsibility
- We provide JacotePOS with reasonable care and skill. Apart from that, it is provided as it is.
- We are not responsible for losses caused by things outside our reasonable control, by wrong information entered by your shop, by staff misuse of their PINs, by cash or stock shortages, or by tax penalties.
- We are not responsible for indirect losses such as lost profit or lost business.
- If we are responsible for a loss, our total responsibility is limited to the amount your shop paid us in the 3 months before the problem (which is nothing during the free pilot).
- Nothing in these terms takes away rights you have under Kenyan law that cannot be taken away by agreement.
10. Ending the service
- You can stop using JacotePOS at any time. Contact us if you want your shop closed.
- We may suspend or close a shop that breaks these terms. Where we can, we will warn you first and give you time to take a copy of your records.
- After a shop is closed, we keep its records for 90 days so you can still ask for a copy, then delete them. Copies in backups are deleted as those backups are replaced.
11. Changes to these terms
We may update these terms. We will show the new date at the top and tell shops about important changes before they apply. Using JacotePOS after that means you accept the new terms.
12. Law and disagreements
These terms are governed by the laws of Kenya. If we disagree, we will first try to settle it by talking. If that fails, either of us may take it to the courts of Kenya.
